Whisay terms of service

Last updated: 28 October 2026

1. General

  1. The Whisay service is provided by Martez Marcin Szołtysek, Majowa 8, 41-706 Ruda Śląska, email support@whisay.com ("we" or "Whisay").
  2. These terms govern the use of the Whisay app for Windows and macOS, the Whisay cloud, the account site account.whisay.com and the whisay.com website. They are the terms for services provided electronically.
  3. Definitions:
    • User or you - a person who uses Whisay.
    • Consumer - a natural person who enters into a contract with us that is not directly related to their business or profession.
    • Sole trader with consumer rights - a natural person running a business for whom the contract is not of a professional nature (shown in particular by the scope of their business in the Polish business register, CEIDG). They have the same rights as a consumer regarding unfair contract terms, withdrawal and conformity of the service.
    • Account - the Whisay account you sign in to in the app and at account.whisay.com.
    • Local mode - speech recognition on your computer, without sending recordings.
    • Online mode or Whisay cloud - speech recognition on the servers of Whisay and our providers.
    • Ultra mode - live dictation in the cloud: text is produced while you speak.
    • Standard mode - dictation in the cloud where the recording is transcribed after the dictation ends.
    • Refine - refining dictated text with a language model (for example an email, a list, a note, a translation).
    • Plan - Free, Pro or Max, as described in section 5.
  4. These terms are available free of charge at whisay.com. You can save and print them.

2. Technical requirements

To use Whisay you need:

  • a computer running Windows or macOS in the version stated on the download page,
  • a microphone,
  • an internet connection to download the app and the model, for online mode and for the account,
  • a web browser and an email address to create an account and manage your plan.

Whisay may be used by persons aged 16 or over.

3. What we offer

  1. Whisay turns speech into text: you hold a keyboard shortcut, speak, and the text appears where your cursor is.
  2. Local mode is free, unlimited and needs no account. It requires downloading a speech recognition model.
  3. Online mode requires an account. What it includes depends on your plan (section 5).
  4. Refine works in online mode. Its output is produced by a language model and may contain mistakes. Check the text before you send it.
  5. Ultra mode is part of the Pro and Max plans. We are rolling it out gradually; until it is available on your account, you dictate in standard mode.
  6. Dictation history, dictionary, snippets and settings are stored on your computer. Details are in the privacy policy.
  7. Your own key mode is an advanced option: the app then connects to a service you choose, at your own cost and under that service's terms. We are not responsible for that service.

4. Account

  1. You create an account the first time you sign in with Google, Microsoft (personal account), Apple (once that method becomes available) or with a code sent to your email. When the account is created, we enter into an account contract for an indefinite period. The account is free.
  2. We do not create new accounts for disposable email addresses.
  3. An account belongs to one person. Do not share it, and keep your mailbox and the accounts you sign in with secure.
  4. You can delete your account at any time:
    • in the app: Settings > Privacy and data > Delete Whisay account,
    • at account.whisay.com: Delete account.
  5. Deleting the account takes effect immediately and cannot be undone. If you have an active subscription, we first cancel it in Paddle with immediate effect, so the plan ends when the account is deleted. The unused part of the period is not refunded automatically; the refund policy explains when we refund. If you want to keep the plan until the end of the paid period, cancel the subscription first and delete the account after it ends.
  6. We may block an account if you seriously or persistently breach these terms (in particular sections 10 and 12) or put the security of the service at risk. We will tell you about the block and its reason by email, unless the law forbids it. A blocked account has no access to the cloud; local mode keeps working. You can file a complaint about a block (section 14).

  1. Trial. Every new account gets 14 days of the Pro plan free of charge, without a payment card. The trial is available once per mailbox, also after deleting and re-creating the account. When it ends, the account switches to the Free plan automatically and you pay nothing.
  2. Billing. Pro and Max are subscriptions billed monthly. We do not currently offer an annual plan.
  3. Prices. Prices in Polish zloty (PLN) include VAT. Prices in other currencies and the final amount with taxes are shown by the Paddle checkout before you pay.
  4. Month. Limits are counted per calendar month in UTC. Unused minutes, hours and words do not carry over to the next month.
  5. For businesses. If you need more, a data processing agreement or your own model, write to support@whisay.com.

6. Payments through Paddle

  1. Subscriptions are sold by Paddle as the reseller (Merchant of Record). You conclude the purchase contract with Paddle, and Paddle's buyer terms apply to the purchase. Paddle takes the payment, issues confirmations and invoices, handles taxes and processes refunds. Whisay provides the service under these terms.
  2. The available payment methods are shown in the Paddle checkout.
  3. The subscription renews automatically every month until you cancel it. The fee is charged in advance at the start of each period.
  4. If a payment fails, Paddle retries it and you keep your plan while it does. If the payment ultimately fails, the subscription ends and the account switches to the Free plan.
  5. You can change your plan yourself on account.whisay.com. Moving from Pro to Max takes effect at once, and Paddle charges the difference for the rest of the current billing period. Moving from Max to Pro also takes effect at once, and the unused part of the Max fee is deducted from your next payment. You see the amount before you confirm the change.

7. Cancelling a subscription

  1. You can cancel at any time at account.whisay.com: Manage subscription (Paddle's secure portal).
  2. Cancellation takes effect at the end of the current billing period. You keep the plan until then, after which the account switches to Free. No further fees are charged.
  3. Deleting the account ends the subscription immediately (section 4, item 5).

8. Changes to prices and plans

  1. We may change the price or scope of a paid plan, including the limits in sections 5 and 10, for valid reasons: changes in provider costs, taxes or laws, changes in technology or providers, the development of new features.
  2. We will notify you of a change to your disadvantage by email or in the app at least 30 days before it takes effect. The change applies from the first billing period that starts after those 30 days.
  3. If you do not accept the change, you can cancel the subscription before it takes effect, at no cost.
  4. Changes in your favour may apply immediately.
  5. Replacing the speech recognition engine or language model within the same mode is not a change to the scope of a plan (section 11).

9. Right of withdrawal

  1. If you are a consumer or a sole trader with consumer rights, you may withdraw from the contract for a paid plan within 14 days of concluding it, without giving a reason.
  2. A paid plan starts immediately after purchase, at your express request made at the time of purchase. Under the Polish Consumer Rights Act, if you withdraw, we may charge for the period of use up to the withdrawal. Under our refund policy we do not do so: for the first payment for a given plan we refund the full amount.
  3. To withdraw, send a statement to support@whisay.com or to Paddle via the link in your purchase confirmation. You may use the model form, but you do not have to.
  4. You will receive the refund through Paddle, using the same payment method, within 14 days of receipt of your statement. The plan ends when you withdraw and the account switches to Free.
  5. You can end the contract for a free account at any time by deleting the account.

10. Fair use rules

"Unlimited" in the Pro and Max plans means free dictation for one person. These rules protect the service from abuse such as bulk file transcription or an account shared by many people. A typical user never comes close to these thresholds.

Local mode is not subject to these rules. It works offline and is always unlimited.

Cloud thresholds

FreePro and trialMax
Cloud per month30 minutes, then the cloud is paused until the end of the monthno minute limit up to the 60-hour ceilingno minute limit up to the 60-hour ceiling

What happens when you go over

  • Soft threshold and end of the Ultra allowance: nothing is switched off, only the engine changes. You keep dictating in standard mode until the end of the month. The app tells you why.
  • 60-hour ceiling: we may pause cloud dictation until the end of the calendar month. Local mode keeps working. We will get in touch about a business plan, because that level of use is no longer personal.
  • Free plan limit: after 30 minutes the cloud comes back the next month. Local mode keeps working.
  • Daily limits protect against errors and automated scripts. Normal dictation stays well within them.

Ultra time is counted only when the text actually reached you. Time dictated in Ultra mode counts towards the 60-hour ceiling and towards the Free plan limit.

Rules

  1. One account is one person. Do not share the account or resell access.
  2. Whisay is for live dictation, not for bulk transcription of files or automatically submitted batches.
  3. Do not get around the limits, for example by creating new accounts for new trials or by modifying the app.

If we notice a breach of these rules, we will contact you first. For a serious or repeated breach we may limit access to the cloud or block the account (section 4, item 6).

11. Engine choice and availability

  1. Whisay chooses the speech recognition engine and the language model, and their providers. We may change them and, when a provider is down, switch you to another one or to the local model if you have downloaded it. We do not show model names. Speed and accuracy may vary between engines.
  2. We work to keep the cloud running without interruption, but we do not guarantee continuous availability. Interruptions may be caused by maintenance, provider outages or internet problems. Some of our providers offer their services without an availability guarantee.
  3. Local mode works without the internet.
  4. The app tells you about updates. It installs them only after you click.
  5. If you are a consumer or a sole trader with consumer rights, we are responsible for the conformity of the service with the contract throughout the time we provide it, as required by the Polish Consumer Rights Act.

12. Acceptable use

You may not:

  • use Whisay for unlawful content or activities,
  • infringe the rights of others, including recording them without a legal basis,
  • try to break security, overload the servers or use our API other than through the app and the account site,
  • resell access or use the output to build competing models,
  • decompile the app, except where the law allows it.

You are responsible for what you dictate and for how you use the text.

13. App licence

We grant you a non-exclusive, non-transferable licence to use the Whisay app, privately or for work, for as long as you use the service and in line with these terms. Open source components in the app are covered by their own licences.

14. Complaints

  1. Send complaints to support@whisay.com or by post to Majowa 8, 41-706 Ruda Śląska. Tell us which account it concerns, what happened and what you expect.
  2. We will reply within 14 days of receiving the complaint. If you are a consumer or a sole trader with consumer rights and we do not reply within that time, the complaint is deemed accepted.
  3. If the service does not conform to the contract, you can demand that we bring it into conformity and, if that is impossible or fails, a price reduction or withdrawal from the contract, as provided in the Polish Consumer Rights Act.
  4. Payment matters (charges, invoices, refunds) are handled by Paddle; you can also write to us and we will help.

15. Out-of-court dispute resolution

  1. As a consumer you can use out-of-court ways of resolving a dispute, for example help from a municipal or district consumer ombudsman, or mediation or the permanent consumer arbitration court at the regional Trade Inspection office. More information is on the website of the Polish competition and consumer protection office (UOKiK).
  2. If we reject your complaint, we will tell you whether we agree to out-of-court resolution.
  3. The EU online dispute resolution (ODR) platform was closed on 20 July 2025, so we do not link to it.

16. Liability

  1. Towards consumers and sole traders with consumer rights, we are liable under the general rules. These terms do not limit their rights under mandatory law.
  2. Towards other businesses, we are liable only for actual damage, up to the fees paid for the service in the last 12 months, excluding lost profits. This limit does not apply to damage caused intentionally.
  3. We are not responsible for other companies' apps into which you insert text, or for services you connect to in your own key mode.
  4. The history is stored on your computer. Keep important texts somewhere else as well.

17. Ending the contract

  1. You can cancel the subscription (section 7) and delete the account (section 4) at any time.
  2. We may terminate the account contract for valid reasons, for example if we stop providing the service, with 30 days' notice. For any prepaid period you cannot use for that reason, we will refund a proportional part of the fee.
  3. In the event of a serious breach of these terms we may terminate the contract with immediate effect, after an unsuccessful request to stop the breach, unless the breach threatens the security of the service or other users.

18. Governing law and courts

  1. The contract is governed by Polish law. If you are a consumer, you keep the protection given to you by the mandatory provisions of the law of the country where you live.
  2. Disputes with consumers are settled by the court with jurisdiction under the general rules.
  3. Disputes with other businesses are settled by the court with jurisdiction for the place where Martez Marcin Szołtysek conducts its business.

19. Changes to these terms

  1. We may change these terms for valid reasons: changes in the law, changes of providers or technology, new features, security reasons, or changes to our company details.
  2. We will notify you of a change by email or in the app at least 30 days before it takes effect. If you do not accept it, you can cancel your subscription and delete your account before that date, at no cost.
  3. Editorial changes that do not make your position worse may take effect earlier.
